我国应当建立遗产破产制度

On System of Heritage Bankruptcy

破产立法最基础的内容就是破产法的适用范围问题。我国现行有关破产法的法律适用范围非常有限,应当修订破产法,突破现行法框架,采取一般破产主义,将其适用范围扩展到所有民事主体和经济主体。遗产破产是其中应予考虑的难点之一。我国有必要确立遗产破产制度,遗产破产制度应当纳入自然人破产制度体系,使之成为其有机组成部分之一。

The basis of the legislation on heritage bankruptcy is the sphere of application of bankruptcy law. The sphere of application of our current bankruptcy law is very limited, which needs revising current bankruptcy law and breaking through its framework and adopting general bankruptcy to broaden its sphere to all civil subjects and economic subjects. Heritage bankruptcy is to be considered in this course.It＇s necessary for Our country to establish the system of heritage bankruptcy which should be included in natural person＇s bankruptcy system and become its organic part.
