试论循环经济法在我国法律体系中的地位

Discussion on the position of Recycling Economy Law in our law system

随着立法工作的不断推进,《循环经济法》草案将提交全国人大常委会审议,循环经济法的出台已指日可待。近来,关于循环经济法的法律性质及其在我国法律体系中的地位问题时有争论。笔者从循环经济法的法律性质和调整对象出发进行探讨,认为可以把循环经济法作为我国法律体系中的一个独立的部门法律。

With the progress on legislation of recycling economy, the draft of recycling economy law will be submitted to standing committee of National Congress for discussing next year. The accomplishment of recycling economy law comes into being. There are some argues about the nature of recycling economy law and its position in the law system recently. Basing on the analysis of the nature and the adjusting object of recycling economy law, the author believes that it can be an independent department law in our law system.
