A Probe into the Legal Invalidation on the Basis of Game Theory

当前,我国存在比较突出的法律失效现象,各种违法行为得不到有效遏制,运用博弈论对法律运行过程中执法者、违法者、权利人三方基于利益最大化原则进行的策略互动进行分析,探寻在此基础上形成的纳什均衡,将为法律失效的原因提供一个新的解读。

Nowadays, quite a few legal invalidation cases frequently occur in modem society, and various illegal actions haven＇t been effectively prevented. The present paper mainly discusses the relationship between the cost profits of three parties involved and their chosen actions, on which basis the Nash equilibrium is argued, so that it will offer us a new analysis for legal invalidation.
