摘要
关于《魏玛宪法》的来源,学术界存在争议。有的学者强调德国文化和传统的作用,有的学者则强调外来因素的作用等。探讨《魏玛宪法》的渊源,应该结合魏玛共和国和《魏玛宪法》产生的背景,《魏玛宪法》实际上是德意志传统、文化与西方自由民主思想和宪政实践共同作用的产物。
