论商标法的价值定位——兼论我国《商标法》第1条的修改 被引量:26

摘要 商标法的价值定位决定了商标法的取向,影响着商标具体制度的设计。目前我国《商标法》将"加强商标管理"、"保护商标专用权"和"维护消费者利益"作为立法宗旨,具有浓厚的计划经济色彩。为适应市场经济的需要,我国应将商标法定位为"维护消费者利益"、"保护商标权人利益"和"维护市场公平竞争",并应以此修改我国《商标法》的第1条规定。 The value orientation of trademark law effects the provision of trademark law. The value orientations of the Trademark Law of the People's Republic of China, which result from the planned economy, are strengthening the regulation of trademark, protecting the exclusive right to a trademark, and protection the consumers' interests. In order to meet the need of market economy, we should make the value orientations'of trademark law as protection the consumers' interests, protection the trademark owners' interests, keeping fair competition.
