新闻记者开展隐性采访时,场合在许多时候会成为决定这种采访是否合法的重要因素之一。鉴于新闻报道功能的特殊性和隐性采访报道内容的重要性,我们必须通过区分场合的不同,来为隐性采访的实施寻找合理的空间。场合一般分为公开场合和私人场合。人们在公开场合的行为是可以昭示于人的行为,可以适用隐性采访。而在私人场合,个人有权排除一切外来干预,故不适用隐性采访。

Occasions in which covert coverage happens might be one of the most important standards to judge whether the coverage is legal or not. As far as the particularity of news report and the importance of the covert coverage content concerned, the causes for covert coverage must be found by distinguishing the different occasions. Occasions could be defined as public and private occasions. We should distinguish different occasions to ensure the legitimacy of convert coverage. In public occasions, people's behavior could be considered as public behavior so the covert coverage could be approached. However, in private occasions, the individual has the right to protect himself from external interferences, therefore the covert coverage is not proper in those occasions.
