行业协会具有民间性、自治性、中介性、行业利益代表性和非营利性等本质特性;在社会经济生活中,行业协会具有服务、代表、沟通协调和自律等功能。行业协会的功能具有重要的法治价值,它能全面地实现并保障经济主体的私权利,制约并保障公权力的良性运作,构筑社会经济秩序的自我调控机制。基于行业协会的正当社会角色及其本质属性,我们应当充分关注并张扬行业协会的功能及其法治价值。

Trade association has essential attributes of non-governmental, autonomy, nonprofit, medium and representatives of business interest. In social economic life, trade association has the function to serve, represent, communicate, co-ordinate and conduct self-discipline. It is of great value in governance by law. It can achieve and secure the private rights of economy subject's comprehensively, form a good operating mechanism to restrict the power of the government, construct autonomous regulation mechanism of social economic order. Owing to its just social role and essential attributes, we should pay a good deal of attention to trade association, publicize its function and its value in law governance.
