谈《物权法》视角下的物业管理

Talking about the property management under the perspective of "Property Law"

《物权法》几经审议修订终于正式发布。这标志着我国将进入物权法时代。从物业管理行业的角度看,《物权法》作为我国调整财产关系的民事基本法律,无疑是物业管理法制建设的又一重大进步,必将对我国物业管理行业发展产生基础性的、长期性的重要影响。本文在《物权法》的视角下,阐述了其与物业管理的关系,并提出了完善物业管理法律制度的设想,以期提高我国的物业服务质量,减少物业纠纷。

＂Property Law＂ has been finally released after consideration and amendments. It indicates that China will enter the era of Property Law. From the point of view of the property management industry, ＂Property Law＂ is another major progress of legal construction of property management as the civil basic law to adjust property relations in China. It is bound to have fundamental, long-term and important impact on the development of China＇s property management industry. This paper, under the perspective of ＂Property Law＂, described its relationship with the property management and put forward the imagination of improving the legal system of property management, with a view to improve the quality of our property service and reduce property disputes.
