司法公正与我国司法现状之分析

Construing on the judicial fair and phenomenon in China

司法公正是法治国家的首要要求,现阶段影响和制约司法公正的因素主要有法律规定的不健全、案件客观上的复杂性、司法人员主观上的因素等方面。实现司法公正是一项长期、艰巨、复杂的系统工程,必须有相应的制度与措施作保障。作者认为,应当通过改革司法体制,维护法官的独立地位,保障审判独立;通过完善司法程序,保证司法裁判过程和结果的公正性。此外,文章还对司法人员(主要指法官)的素质问题进行了论述分析。

The judiCial fair is the principal recuest in the jural country,but now, there are many factors in- fluerce and srpervise the judicatory fair, for example, the unwholesome law reules, the objective complexity of a case, and tne subjective factors of a judicial member. To carry out tthe judicatory fair is a long,onerous and com- plex systematization project,it, needs corresponding system and measure to make a guarantee. The author thinks the first,we should reform the judicial system to maintain the judge＇s independent position and mac judgement independence.The second,we should perfect the judicial process to make sure the judicatory judge＇s process and result are justicing.At the same time,the text also consider the judicial member＇s fibre（emphasize to mean the judge＇ s here）.
