Discussion of mining registration regime

将矿业权分解并重构为矿产权、特许权和企业产权,三者的登记构成矿业登记制度,但不是矿业权登记:矿产权登记适用物权法而统一登记;经特许授权的探采资格登记归于矿业部门属行政登记;对矿产施行探采活动的矿山企业设立是由工商行政登记;为避免政府和社会埋单的矿山企业退场登记非常重要。

Mining right is divided into mineral right, chartered right and enterprise property right. The registration of these three rights makes up mining registration regime but is not registration of mining right. Mineral right registration is unified registration meeting Law of Property. The registration of chartered exploration g〉 mining qualification belongs to administrative registration managed by mining authority. The registration of establishment of mining enterprise conducting exploration ＆mining activities is commercial ＆ industrial administrative registration. For avoiding that government or society make payment, the closure registration of mining enterprise is very important.
