摘要
本文通过对浙江RA市的实证分析发现,不同用途的农村集体土地转为国有建设用地后,政府与农民集体间的增值收益分配相差悬殊,根本原因在于,不同用途的农村集体土地征地补偿不同,在其转为同样用途的国有建设用地后却以同一价格出让。这种做法表面看起来合理,实质上却损害了农民集体的利益,侵犯了集体土地所有权。
Based on the demonstration on the city of RA in Zhejiang Province,this paper shows that there are significant differences between the government and the farmers in value-added distribution of proceeds after the different uses of the rural collective lands become the state-owned building sites.The fundamental reason is that different uses of the rural collective lands have different land compensation,but they have the same price to sell after they switch to the same use of state-owned land for building.This approach sounds reasonable,but actually it harms the interests of collectively farmers and also violates the ownership of collective land.
