联合国国际法委员会2006年所制定的《外交保护条款草案》,既属于对外交保护领域习惯国际法规则的编纂,又在很多方面属于对国际法的创新和发展。整份草案,突出了对人权的保护,强调了国家在特定情势下对本国国民行使外交保护的义务。

The draft articles on diplomatic protection adopted by the International Law Commission in 2006 not only codifies customary international law in the field of diplomatic protection, but also develops some rules in the same field. The entire set of draft articles pay much attention to the protection of human rights, especially the duties and obligations a state burdened to exercise diplomatic protection in respect of his nationals under some special circumstances.
