环境法的伦理审视

An Ethical Review of Environmental Law

环境伦理是把基本社会道德规范推广到自然界并把生态平衡作为一种重要的工具价值加以重视。本文分析了这种伦理审视环境法的必要性,论述了环境法与伦理之间的两层关系:从价值层面上,环境法应服从伦理评价和伦理价值取向;在规范层面上,环境法与环境伦理是互补的不同规范。在此基础上论述了伦理审视的可能性。最后,文章指出了伦理审视环境法应注意两个问题:第一,用什么伦理审视的问题,即伦理模式的选择问题;第二,伦理审视环境法的范围。

Enviromnental ethics is to extend basic social ethics to the nature and attach importance to the ecological balance of nature as a main tool value. This paper analyzes the necessity of reviewing environmental law in the ethical perspective, and discusses the two levels of relationship between environmental law and ethics：on the value level, the environmental law should be subject to ethical evaluation and ethical values orientation; on norm level, environmental law andenvironmental ethics are complementary norms. On the basis of this view, this paper discusses the possibility of ethical review. Finally, the paper indicates that the ethical review of environmental law should focus on two issues： i. e. what kind of ethics can be used to review environmental law, namely the choice of ethical mode and the scope of ethical review of environmental law.
