On Improvement of Judicial Budget System in China——Analysis Focused on Court

司法预算是整个司法制度与司法程序运行的物质基础,司法预算的审批、编制、分配以及监督对于实现司法独立以及提高司法质量都具有非常重要的意义。然而,由于我国司法预算在审批、编制、分配以及监督等方面都存在严重的缺陷,已经严重影响到司法的公信力和公正度,有必要在借鉴域外成功经验的基础上,建立独立的、由中央统一负责的司法预算审批机制,合理的司法预算分配体系以及有效的预算监督机制,以提高我国司法机关的司法能力和司法质量,提升司法权威。

Judicial budget is the material foundation of judicial system and judicial procedural operation. Approval, planning, distribution and supervision of judicial budget are of great importance to realize judicial independence and improve judicial quality. However, there are serious defect in approval, planning, distribution and supervision of judicial budget in China, which have affected judicial confidence and justice. It is necessary to make full use of successful experience overseas and establish an independent, centrally responsible judicial budget approval system, reasonable judicial budget distribution system and affective budget supervision system so that to improve judicial competence, quality and authorization in China.
