摘要
执行回转制度是我国执行救济中除了执行异议外的一项相当重要的制度,对于保障权利人的合法权利有着不可替代的作用。对于执行回转中原受益人应当返还的财产范围以及原受益人和人民法院在执行回转中所应当承担的法律责任,应根据具体的条件和情况来确定。
Recovery of execution is a very important system besides the execution objection within our execution remedies system, which has an essential effect on ensuring the legal rights of the right holders. The range of the property which the former beneficiary should return back in the recovery of execution, and the legal liabilities that the former beneficiary and the people＇s court should take should be fixed according to the practical conditions and circumstance.
