摘要
随着区分所有建筑物的出现和发展,物业管理日益受到重视,以建筑物区分所有权为基础的物业管理权理论也逐步完善。物业管理权依行使主体不同可分为区分所有权人的物业管理权和非区分所有权人的物业管理权。非区分所有权人享有物业管理权的基础是其因享有的基础权利而取得的建筑物区分所有权之成员权的一部分,其行使物业管理权的范围依基础权利实现的需要来确定。
