关于建立农业立法后评估制度的构想

On the Conception of Establishing the Assessment System after Agricultural Legislation

农业立法后评估是提升农业立法质量的一项重要制度,目前该制度在中国农业立法中尚属空白,因此,有必要进行深入的研究和探讨。作为一种制度创新,农业立法后评估具有重大的理论及现实意义。一方面,它将推动农业立法思想的发展和立法观念的转变,另一方面,它将在实践中发挥全面、客观检视农业立法实效性和合理性的作用,促进农业立法的科学化、民主化,不断提高农业立法的水平,进而为发展现代农业和建设社会主义新农村提供可靠的法制保障。然而,农业立法后评估制度的构建是一项非常复杂的系统性工程,为了勾画出一个切实可行的构想方案,首先对农业立法后评估的概念进行了界定,介绍了农业立法后评估的现状,同时对该制度的各项构成要素进行了初步的分析论证,探讨了评估的主体、对象、内容以及评估的原则、标准、方法和程序,从整体上提出了关于建构农业立法后评估制度的意见和见解。

Although it is an important system to improve the quality of agricultural legislation, the assessment after agricultural legislation has not been established yet. Therefore, it is necessary to research and discuss the question deep. The author think, as an innovation of system, the assessment after agricultural legislation will have an important significance both in the theory and in the practice of agricultural legislation. On one hand it will promote the development of legislation thought, on the other hand it will play a great role to check the efficiency and rationality of agricultural legislation, and it will strengthen the level of agricultural legislation in science and democracy. Finally, it will continuously better the quality of agricultural legislation so that a series of reliable law can be provided, which will become the foundation of system to develop modem agriculture and construct a new socialist countryside. However, establishing the assessment system after agricultural legislation will be an extremely complex systematic project. In order to draft a feasible conception plan, the author first discusses and determines the concept of assessment after agricultural legislation, and introduces the present situation about it, simultaneously puts forward the preliminary analysis to each integrant elements of the system. Based on the research and analysis to the organization, object, contents, principle, standard, method and procedure of the assessment, the author come up with the opinions and ideas about mapping out the assessment system after agricultural legislation.
