摘要
新颁布的《劳动合同法》具有倾向雇员、鼓励稳定、强调集体协商、与国际惯例接轨等特点,给企业的人力资源管理提出了新的课题。企业惟有转变观念,树立劳动合同长期化、提高招聘谨慎性、企业承担举证责任、建立三方协商机制、运用柔性化管理方式保留雇员、人力资源外包等理念,才能从容应对潜在风险,在激烈的市场竞争中立于不败之地。
Newly published law on Employment Contracts, which is featured with emphasizing on protecting the lawful rights and interests of employees, promoting harmonious employment relationships, emphasizing on the collective bargaining mechanism, complying with internal rules and regulations and so on, inevitably challenges current human resource management of enterprise. Enterprise should change traditional views of human resource management and establish ideas of long-term employment contract, strengthening the strictness of recruitment, enterprise' s responsibility for evidence, the comprehensive tri-partite mechanism, hold employee by flexible management style and outsourcing of human resource. Then, enterprise could confront the latent risk composedly and remain invincible in furious market competition.
