知识产权战略背景下少数民族传统工艺的法律保护研究——以湘西土家族苗族自治州为例

On Legal Protection of Traditional Workmanship in Ethnic Areas from the Perspective of Intellectual Property Right——Taking Western Hunan Tujia and Miao Autonomous Prefecture as the Example

传统工艺的保护与传承对发挥欠发达国家和地区的知识优势具有重大意义。少数民族地区由于历史的和经济的原因对于此种保护的需求显得尤为迫切。我们对湘西土家族苗族自治州的调查研究表明,造成少数民族传统工艺保护不力局面的原因既有现代生活方式的冲击,也有传统工艺自身局限性的影响,更重要的是观念、立法、政策的不到位。应从两方面积极应对:一是应努力寻求知识产权法对少数民族传统工艺的保护;二是完善和落实少数民族传统工艺的特别法保护。

It＇s important to protect traditional workmanship in developing countries and areas, especially in underdeveloped minority regions. Our investigation and research from show that the reason why we can＇t protect the traditional workmanships well is that the traditional technology itself has some limitedness, and more importantly, the idea, the legislation and the policy is not healthy enough. To change such a situation, two ways should be taken. On one hand, we must protect traditional workmanship with intellectual law. On the other hand, we should consummate the special law on this field.
