摘要
介绍海运提单中仲裁条款的法律地位和效力,通过对班轮条件下提单仲裁条款和租约下提单中的仲裁比较和中国对临时仲裁的效力认可以及影响仲裁条款的情形探讨,对当前的海运提单仲裁条款的适用和效力问题进行分析。
The paper introduced the legal status and effect of arbitration clause of bill of lading, and could get clearly acquaintanceship on the arbitration clauses by comparison between bill of lading of liner shipping and bill of lading of charter, and discussion of the instant arbitration application in China, and would know more the arbitration clause of the bill of lading and its legal affection.
