沉船强制打捞清除费用有时无法得到有效补偿,从而制约了强制打捞的及时进行。尽快建立一种新的能有效运行的沉船强制打捞清除费用补偿机制,是迫切需要解决的问题。将沉船打捞基金制度同现有的其他补偿机制方案进行比较分析,从多方面、多角度论证在中国设立沉船打捞基金的必要性和可行性。

The costs of compulsory wreck removal can＇t be fully indemnified so as to restrict the prompt removal of wreck. It is urgent to establish a new and effective compensation system for the costs of compulsory removal. This paper made a comparative analysis on the system of fund for wreck removal with other compensation regimes, and demonstrated the necessity and feasibility of the establishment of a fund for wreck removal in China from various aspects.
