构建我国请愿制度的若干思考

On the Construction of Chinese Petition System

请愿权作为公民的一项基本权利具有重要的宪政价值,而请愿权在我国缺乏法律的规定,与请愿权相关的制度安排——信访制度也存在很大缺陷。因此,要构建真正意义上的现代请愿制度应做到三点:一是更新请愿观念;二是完善法律规定,包括将"请愿权"写入宪法和制定请愿法;三是建立专门的请愿受理机构。

Chinese constitution and laws lack the relevant regulations on the right to petition,and inquiry system-the institutional arrangement in relation with the right to petition also have more of defects.Therefore,to build a true modern petition system,we must update the concept of the right to petition,improve relevant laws and regulations and establish the specialized agencies accepting the petition.
