河北省农村妇女土地权益保护状况研究

Research on Protection of Women's Rights to Land in Rural Hebei

本文结合河北省实际,从理论和实践两个层面,对农村妇女土地权益的保护问题进行了全面探讨。分析了当前河北省妇女土地权益的特征以及现行政策法律的不足,介绍了其他省的经验,并就村民自治如何做到民意性与合法性的统一、出嫁女的村集体经济组织成员资格界定等热点问题,提出了自己的看法。

This paper examines issues in the protection of rural women＇s rights to land in Hebei both in theory and practice. It seeks to identify characteristics of rural women＇s land rights as well as the conditions under which rural women enter into disputes on land rights. It sifts out shortcomings in existing policies and evaluates on-going experiments by other provinces. It provides suggestions on focal questions including how to unify legality and sentiments in villagers＇ practice of self government and how to recognize women who have married outside of the village and their status as members of the village collective economy.
