The most characteristic of John Stuart Mill utilitarian theory is the combination of utilitarian- ism with justice and freedom rights. Moral rights in Mill＇s utilitarianism system plays an important role. First through the discussion on Mill＇s the viewpoint of freedom and justice, the paper expounds the rights in his utilitarian theory,in particular the importance of moral right. Second, through the reinterpretation of Mill＇s utilitarian theory, it shows his moral theory itself is the accommodation and protection of rights.
