Thoughts on Restructuring of Forensic Appraisal Institutions

本文从《决定》出台后司法鉴定的现状分析入手,从实践的角度剖析了我国司法鉴定机构的主要特点和存在的问题,对司法鉴定机构性质的定位进行初步探讨,提出了要重塑司法鉴定的权威性和提升司法鉴定的公信力。

With the promulgation and implementatiom Of ＂the decision of the Standing Committee of the National People＇s Congress on forensic appraisal administration＂, fornsic appraisal institutions are advancing in the direction of Socialization, i,e,, privatization. From the practice of the past two years, although some progress has been made. there have also been a lot of problems, particularly the conflict between the institution＇s tendency of maximizing profits and the society＇s request of serving public welfare. It is now an urgent issue to construct independent and impartial forensic appraisal institutions. This paper starts with the analysis on the status quo of forensic appraisal after the enactment of the Decision mentioned above, dissecls the main characteristics and existing problems of Chinese forensic appraisal institutions from a practical angle, tries to define the natnre of the forensic appraisal institutions to certain extent, and argues that in order to rebuild the authority and enhance the credibility of forensic appraisal, it is necessary to establish institutions under a comprehensive structure consisting of national, provincial, city, and county institutions specializing in forensic appraisal.
