On the Scope of the State's Compensation

国家赔偿范围作为国家赔偿法的核心问题,其界定直接影响到公民合法权益的保护程度。我国国家赔偿范围是最突出问题即是其被限定得十分狭窄,且已无法适应当今社会的发展需要。在借鉴外国国家赔偿法相关规定的经验以及结合我国国情的基础上,分别从国家赔偿的事项范围扩大,国家赔偿的侵权行为范围扩大,国家赔偿的权益范围扩大三个方面对国家赔偿范围进行论述。

The state＇s ＂Law of Compensation＂ must be feasible since it is an important means of the state guaranteeing citizens basic rights, based on the Constitution. The present study aims to explore the scope of the state＇s compensation in the three aspects： extension of item scope, extension of tort scope, extension of rights and interests. In the study, careful considerations have been given to the existing national conditions and relevant rules and regulations concerning compensation law in foreign countries.
