摘要
2001年之前,我国对驰名商标的认定从无到有,其认定模式是单一的行政认定模式。2001年之后,随着最高人民法院相继出台两部司法解释,法院也有权对商标是否驰名进行司法认定。从此,我国进入了行政认定和司法认定并存的双轨制时期。但双轨制模式下存在许多的问题,如双轨制模式是否符合国际惯例;对行政认定和司法认定主体合法性的评价;对认定方式的评价;对认定程序的评价;两种模式存在着什么样的先天隐患;两种模式认定驰名商标的法律效力评价。
Before 2001, China initiated its homologation system of well-known trademark, but it is then a single-track system. After 2001, with the appearance of two judicial interpretations by the Supreme Court, courthouses are entitled the power to determine whether the brand is famous or not. Ever since then, China has entered the time of dual system namely judicial determination and administrative determination. However, problems exist in this dual system, while in order to solve these issues, this paper discusses six questions., whether the dual system is in line with the international convention; evaluations on the subject legitimacy of judicial determination and administrative determination; evaluations on method of homologation; evaluations on homologation procedures; analysis of in-born hidden troubles of the two systems; evaluations on legal effect of the two determination systems. In the end, suggestions are offered for betterment of the two determination systems.
