On Legal Countermeasure to Crime by Taking Advantage of Duty of Rustic Cadre

近年来,村干部违法犯罪频频发生,严重破坏了党群关系,助长了腐败风气,影响了农村社会稳定。本文通过对村干部职务犯罪现状的分析,揭示了在惩治此类犯罪中司法人员在适用法律方面存在的问题,寻找解决此类问题的途径和方法,使得对此类犯罪在处理的过程中真正做到有法可依,以维护农村的和谐稳定,促进社会主义新农村建设快速发展。

In recent years, the irregularity and crime by rustic cadres become more and more. It seriously damaged the relation between the Party and the masses and fostered the corruption ethos and impacted society stabilization. By analyzing the present condition of the crime by taking advantage of duty of rustic cadre, the author discloses the law application problems while dealing with the crime and seeks for the route and method to solve the problems so as to restrict and strike the crimes by rustic cadres and maintain rustic society stability and accelerate the socialism new county construction.
