摘要
劳资关系主要是由劳动和资本两大要素组成的,它有统一性,又有对立性。其对立性是由劳动者对工资追求的最大化和企业对于利润追求的最大化所致。目前我国的劳资关系为劳动弱势,资本强势,劳资关系两极失衡,劳动关系不和谐已成企业主要矛盾。如果劳资矛盾进一步加剧,必然发生冲突和对抗,破坏社会和谐,影响社会稳定。本文从我国当前经济转型背景出发,分析我国企业劳资关系不和谐的现状,提出构筑我国企业劳资关系双重法律架构的理论基础及探索实施的主要路径。
Labor and capital are the two main elements of labor relations which has its uniformity and antagonism. Its antagonism is induced by the workers in the pursuit of profit maximization on wages while the enterprises in the pursuit of profit maximization. At present, disadvantaged labor and strong capital are status quo in China's labor relations which lack bipolar balance. Labor relations' discord becomes the major conflict in enterprises. If the labor dispute continues to intensify, there could be conflict and confrontation, and undermine social harmony and stability. This essay, based on China's current economic restructuring background, analyzed the disharmonious situation of China's labor and capital relationships and proposed the theoretic basis in building the dual legal framework between the capital and labor and explores the main path of implementation.
