宪法诉讼具有四个方面的属性,即:客观性、多维性和衡平性、绝对性以及相对性、伦理性。民主在直观上不符合价值评判关系的基本原理,因而它属于宪法诉讼的非构造性价值。对其实质性内涵可以从两个层面加以界定:其一,工具性的民主价值。这种价值实质上就是传统意义上的多数民主价值,即秩序、法治之价值。其二,目的性的民主价值,即自由之价值。前者是基础,后者是目的,对后者的寻求应确立在前者的基础之上。

The value of the constitutional litigation is a kind of relation that the main body adapts the power and the behavior of the censorship to its aim and needs. The value of the constitutional litigation has four attributes, namely, the objectivity, the balancing, the absoluteness and the relativity, and the ethic. The democracy can he attributed to the non-construction value. The essential connotation that democracy is taken as the value goal of constitution lawsuit mechanism can be divides into two parts. The first is instrumental democratic value. The value is in fact the majority democratic value in traditional meaning, including the values of order and rule by law. The second is purposive democratic value, ie. the value of freedom.
