当前滥用反倾销已成为某些国家推行贸易保护主义的一种重要手段,严重扭曲了自由竞争的贸易秩序。我国连续12年成为遭遇反倾销调查最多的国家,但是我国对进口产品发起反倾销调查案件却很少。与具有丰富反倾销经验国家的相关法律相比,《中华人民共和国反倾销条例》在适用过程中仍存在很多缺陷。我国反倾销法律制度对于倾销的认定存在缺陷,对损害确定的规定比较粗糙,缺少"交叉累积"、反税收问题等的规定,对因果关系的程度缺乏认定,缺少"代表第三国的反倾销行为"的条款,"公共利益"条款尚不完善,对反倾销程序的规定存在缺陷,司法审查机制不具体。应构建和完善我国的反倾销法律体系,保护我国的民族产业。

The abuse of anti-dumping has become an important means of implementing trade protectionism in some countries,which seriously distorts the trade order in free competition.Faced with the largest number of cases than any other countries in the world,China has received investigation of anti-dumping for twelve years.However,there are few cases of anti-dumping launched by China for imported commodities.Compared with the country which has rich experience in anti-dumping laws,there are a lot of failings pertaining to PRC's Regulations on Anti-dumping.First,the system of anti-dumping law in China is lack of principle for identifying dumping.Second,the provisions for determining damage are inaccurate.Third,the system is short of 'overlapping accumulation' and the provisions for anti-tax issues.Fourth,the system is deficient in cognizance on the degree of the cause and effect relationship.Fifth,the system is lack of provisions for'a third country on behalf of the anti-dumping practice'.Sixth,the clause of 'Public Interest' is imperfect.Seventh,the provisions for the anti-dumping procedures have deficiencies.Last,the judicial examination mechanism is not specific.Therefore,China should construct and improve the system of anti-dumping law in order to protect Chinese national industry.
