社会舆论与司法审判互动的个案研究

Case Study on the Interaction of the Public Opinion and Judicial Judgment

司法活动与社会舆论存在互动。本文采取个案研究法,运用系统论原理,对这一社会过程的内在机制进行描述分析,得出我国司法运作系统的一般模型——金字塔模型。转型时期我国的法律制度框架与变革中传统文化之间存在矛盾,所以应当追求一种更具合理性和现实性的司法正义,即协商型正义。社会舆论与司法之间的互动是良性的,促使司法向着更完善地保护人民权利的方向缓慢演进,同时推动着法律规则本身发生变革,并由此促进协商型司法正义的实现。

There are interactions between judgment and public opinion. In this thesis, the structure of public opinion, pyramid model, lies in legal affairs and the intrinsic mechanism of the social process that social consensus affects judicial judgment were analyzed in detail by using individual case method in case sociology and theory of system control and minus feedback to search for the justice that should be after in the changing era in our country, named consulting justice. The interaction is so good to push the public makes law more powerful to protect civil right by the consultation and interplay with judicial department and political department. They are also reforming the law itself so that the consulting justice can be realized.
