The Structure of the Police Administrative Contract Theory

现代行政民主、法治的理念正在不断地完善,高标准的依法行政的呼声也是越来越强烈。担负着特殊使命和任务的公安机关,以前那种"硬式"行政方式已经不适应社会的发展了,这就需要更为灵活的行政方式来适应不断发展的社会。行政合同在公安行政执法领域中的运用,适应了现代公安行政管理发展的需要,使公安机关与相对人间的关系从命令——服从关系发展到了服务与合作的关系。

The basic philosophy of the modern democracy and nomocracy is constantly improving and refining,the high standard of the administration of law is increasingly strong vioce.The previous ＂rigid＂ administrative meaus of the police with special mission and mandate have not been suitable for the development of society.So it requires more flexible and softer administrative method to adapts to the need of the modern development of the police administration,and which is a change to the police administration.It causes the relationship between the police and the relative human from the order——subordinate to the service and cooperation.
