On Transformed Crime

转化犯是我国刑法所独有的名称,是对犯罪行为发生转变后罪数形态的概括。转化犯的提出拓展了刑法罪数形态的理论,对司法实践有一定的指导意义。转化犯应限于故意犯罪之间的转化,且应坚持主客观相统一的原则认定转化犯。

Transformed crime,which is particularly named by the Chinese Criminal Law,generalizes the crime quantity state caused by the transformation of the criminal offence.The proposing of the transformed crime expands the theory of the crime quantity state in criminal law and has some guiding significance for the judicial practice.Transformed crime should confine to the transformation of inteutional crime and the determination of transformed crime should adhere to the principle of integration of objectivity and subjectivity.
