本文从格式条款的概念分析导出其法律特征,并从格式条款的特征入手分析了对格式条款的认定,以格式条款的特别提示义务、特殊解释规则、效力判定等方面论述了格式条款的法律适用,最后笔者提出了一些有关格式条款法律制度完善的建议。
