摘要
回归之前,澳门地区属于准殖民管制型法制,特点在于大多数法律脱胎于葡国法律,由于社会文化的差异。这些法律对於主要由华人构成的澳门社会并不能发挥应有的价值,未能真正深入澳门社会。也就是说,法律规则与法律目标分离、法律设计与法律实效脱节。因此,法律本地化就成为澳门法制转型的中心议题,是《澳门特别行政区基本法》(以下简称《基本法》)的核心内容之一,也是特区政府首先需要完成的工作。
Before Macao's return to China in 1999, the legal system in Macao belonged to a typical typeof quasi-colonial control law system, with a majority of the laws applied in the region derived from Portuguese laws, which was a major characteristic of the law system in the region. As a result of differences in cultural background, those laws could not well play their due roles in Macao society, composed of residents mainly of Chinese origin, and could not genuinely go deep in Macao society. In other words, legal rules went beyond legal objectives while the designing of law was out of line with the practical effect of law. Therefore, since Macao's 1999 return to China, localization of law has become a central subject under discussion in the transition of the legal system of Macao. Localization of law is not only one of the core contents of the Basic Law of Macao, but is also part of the work that the government of the Macao Special Administrative Region (SAR) is required to primarily accomplish.
