对我国农民经济合作组织法中若干问题的探讨

Discussion on Some Problems in Chinese Law of Peasant Economic Cooperative Organization

新出台的《农民专业合作社法》规定了农民专业经济合作组织在市场经济中的行为,促进了农村经济走向规范化和法制化。但关于农民经济合作组织为何种法人,排除农民金融合作组织于合作领域之外是否合理,合作社的投资方式以及政府在这些关系中的定位等问题还存在一定的缺陷,须立法加以完善,文章对以上问题作了相关思考。

It was thought that the newly issued ＂Law of Peasant Professional Cooperation＂ regulated the behavior of professional economic cooperative organizations of peasants in the market economy, promoted rural econonry toward standardization and legalization. But there are some disadvantages in the problems about what kind of cooperation the peasant economic cooperative organizations are, whether it is reasonable to exclude peasant financial cooperative organizations from cooperative domain, and the problems of the investment way of cooperation and the localization of government in these relationships, It needs to be perfected through legislation. The above problems were thought in the article.
