流浪者的权利与国家权力

Right of Beggars and Power of the Nation

由于一个人沦为贫困者的概率是相当的,从无知之幕的状态下出发,保护弱势群体其实也就是保护了我们未来贫富并不确定的自己。国家权力的职责是为不幸的流浪乞讨群体提供生存的机会,致力于消除流浪乞讨的社会原因,而不是一味地禁止流浪和乞讨的行为本身。民政部作为主管社会救助与福利的职能部门,有义务维护流浪乞讨者群体的合法权益。而在法律没有明确规定的情况下,法官有义务支持民政部门代理流浪者向侵权者索赔的责任,以维护法律的基本价值和社会秩序的连续性。

Since everyone might have the possibility of falling poor, it is reasonable that protecting inferior group is also protecting ourselves. Based on the unknown state from the very beginning, we can also have an unknown future. The responsibility of national power is to supply begging group with a surviving opportunity and to eliminate the social causes.of roving and begging instead of forbidding the behavior itself. Ministry of Civil Affairs, as a responsible department in charge of social rescue and welfare, is obliged to protect the legitimate rights of begging group. Also, in the condition where the law is unclear, the judge has responsibility to support the beggar＇s law suit for those who hurt them in order to protect the essential value of law and the consistence of social order.
