论保护濒危非物质文化遗产执法机制存在的问题

On Issues of Enforcement Mechanism of PRC for Protecting the Intangible Cultural Heritage

经济全球化趋势的加强对各国非物质文化遗产产生了较大的冲击,我国许多民间文化艺术形式正面临着割裂消失、甚至被异化的危险境地;中国传统的口头、形体和其他种类的艺术形式,譬如刺绣、印染、剪纸、雕刻、中医药、针灸等非物质文化遗产的生存发展和保护都面临困境。我国正式加入《保护非物质文化遗产公约》后,应当加强保护非物质文化遗产的执法机制,提高对非物质文化遗产保护和知识产权行政执法保护水平。

With tile trend of economic globalization, there is a great influence on protection for the intangible cultural hcritage in really countries,a lot of folk artistic culture in China is coufronted with bad condition which become disappeared and will be even by the dissimilation danger condition; how to develop and protect the other kind artistic form of the intangible cultural heritage, for instance, Chinese folk rap art, embroidery, printing and dyeing, paper-cut, sculpture, traditional Chinese medicine and acupuncture will be confronted with difficult condition. After China＇ s accession to ＂the Convention of Protection of the Intangible Cultural Heritage ＂, in practice, China should reinforce legislative and admiuistrative euforcement mechanism of protection for the intangible cultural heritage, and improve the level of protection system for intellectual property rights and the intangible cultural heritage.
