公安执法理念之思考

Thought on the Concept of Public Security Organs' Enforcement of Law

在现代法治社会中,任何执法行为总是受制于一定的执法理念的指导,执法理念制约着执法行为的走向及其运行,滞后的执法理念不可能产生良性的执法运行机制。因此,执法理念的变革与创新是制约执法行为的走向及运行的重要因素。公安民警在执法过程中,应积极执法、善意执法、规范执法、文明执法、平等执法、公开执法、人性化执法,要敢于执法,兼顾好实体公正与程序公正,处理好严格执法与人性化执法的关系,在执法过程中应坚决摒弃法外循环。

In modem society ruled by law, any enforcement action of law has to be guided by a certain concept.The enforcement concept of law restricts the tendency of legal enforcement action and its operation. It is impossible for the backwards legal enforcement concept to bring out favorable legal enforcement working system.Therefore, the transformation and innovation of concept are the significant factor which restricts the tendency of legal enforcement action and its operation.The police should enforce law actively, kindly, normally, politely, equally,openly, humanely. The police should dare to enforce law, at the same time, pay attention to both entity fairness and procedure fairness, deal properly with the relation between strict enforcement and humane enforcement, get rid of the cycling out of law firmly in the course of enforcement of law.
