竞争起点公平与过程公平的实现——我国构建公平竞争的法律保障制度刍议

Fulfillment of the Equity of Competition Starting-Point and Process——on Construction of Legal Guarantee Systems of Equitable Competition Law

从动态的视角来看,市场经济中的竞争公平包括竞争起点的公平和竞争过程的公平。竞争起点的公平又包括外在的竞争起点公平和内在的竞争起点公平。我国公平竞争的法律保障制度应当确保外在的竞争起点公平,矫正内在的竞争起点的非合理差异,并且规制竞争过程中的不公平竞争行为。实现市场竞争的实质公平,维护竞争起点的公平是关键,保证竞争过程的公平是核心。

From the dynamic perspective,the equity of competition in market economy includes both the one of competition starting-point and the one of process.The former includes exterior starting-point equity and the interior one.The legal guarantee systems of equitable competition should guarantee the former,revise non-reasonable discrepancy of the latter,and regulate the unfair competition during the competition process.To fulfill the natural equity of market competition,the key is to maintain the equity of starting-point,and the nucleus is to ensure the equity of process.
