摘要
民间法是同人类社会同时产生的。初民社会,由于个人力量的有限,在恶劣的环境下不能独立地生活,人们都集合在一定的群体(家庭、氏族)下,为了调整群体内部的秩序和个体之间的权利义务关系,产生了最早的法。回朔法的发展,经历了由禁忌、道德、习俗三位一体到习惯法进而扩展融汇成民间法直至完善成熟为成文法这样一个并不规则的递变过程。从中可以窥视彝族民间法的历史传承和现代作用。
The folk law and society appear at the same time. At the beginning of the national society, people cannot live independently because of the limited individual capacity and bad environment. People gather together in the certain group like family or clan, the earliest law appears for adjusting the inner order of the group and the right and responsibility of members. The development of backtracking goes through such an irregular changing process from the trinity of taboo, morality and custom to habit law expanding and mixed as the folk law till a perfect written law. From it, we can see the modem effect and historical heritage of Yi folk law.
