摘要
在市场经济的自由竞争原理下,二重买卖在现代房产交易中较为常见。文章旨在以物权变动的立法选择为背景,比较研究债权意思主义、物权形式主义与债权形式主义制度设计,着重分析房屋二重买卖时买卖合同的效力、标的物所有权的最终归属以及受害人的法律救济等问题。
Dual transaction of tenement is common in modern transaction of tenement under prindples of free competition of market economy. This paper intends to, under the background of legislative choices of alteration of real rights, compare and study the design of systems of creditor' s rights intentionalism, creditor's rights formalism and real rights formalism, focus on the analysis of the validity of contract, the final ownership of the object and the legal relief of victims in the transaction of tenement.
