摘要
义务教育阶段出现择校与"就近入学"的冲突是不容回避的现实问题。择校从政府教育资源配置、儿童受教育权、法理和学校发展几个方面构成了对"就近入学"的诸多挑战。从法理学的角度分析择校与就近入学的理论分歧及其实质,目的在于协助政府有效地实施义务教育法律、法规及政策。
The school- choice is constituted much challenge to entering school near home from the installation of government educational resources, the children educational rights, the legal theory and the development of school. The purpose of the analysis learned from the legal theory that the theories disagree and quiddity between school - choice and entering school near home, lies in looking for a reasonable value tropism for the establishment of the related compulsory education law, norm and the policy.
