摘要
以征地的公益性划分为基础,设计出我国征地改革的逻辑框架,以区分不同性质建设用地的一级流转方式。其中,纯公益性用地以土地所有权征收的方式获得,准公益性用地以土地使用权征用的方式获得,而非公益性用地则应通过土地使用权市场交易的方式取得。
The paper expounds the public premise in requisition and designs the logic frame of land requisition reform. The land requisition includes three aspects of land property business basing the public premise order. For the absolute public premise construction land, the government branch may buy forcibly the property of the collection. For semi-public promise, the government can authorize given enterprise privilege requesting the collection land usufruct. As regards non-public promise construction land, the general enterprise must buy the collection land usufruct at the land usufruct marketing.
