促进行政执法规范化的现实思考

The Realistic Thought on Promoting Administrative Law Enforcement Standardization

我国行政机关的治理范式逐步由"管理"向"执法"转变,行政执法主体大都能做到执法合法、公正、廉洁,执法规范化成效显著。但不可否认,由于多种因素的影响,目前我国的行政执法规范化还存在一些突出问题,立法不规范、执法程序不严格、行政执法利益化以及执法中的短期行为是其主要表现。推进立法工作、强化程序理念、转变执法方式是当前促进行政执法规范化的基本举措。

The operating model of our nation＇s administrative organization has been changing from ＂management＂ to ＂law enforcement＂. Most of administrative law enforcement agency ensures the law enforcement legally, fairly and honestly, and achieves great success. But as a result of many factors, our nation＇ s standardization of administrative law enforcement also has some severe problems：the imperfect legislation, the imperfect law enforcement procedure, the mercantile administrative law enforcement as well as the short-term behavior in the law enforcement. These are the main performances. Promoting legislation, strengthening procedure idea and transforming the law enforcement ways are the basic actions to promote administrative law enforcement standardization presently.
