摘要
对计算机软件的法律保护有必要从依赖传统法律体系保护向建立新型法律制度保护过渡。对计算机软件的保护应从传统知识产权法体系中汲取营养,同时应体现软件自身的特点和顺应软件产业发展的需要,我国应为这个转变贡献自己的力量。对计算机软件保护特别法律制度的建立同样有助于对集成电路布图等新型知识产权的保护开辟道路。
It is necessary for the legal protection of computer software to transit from the traditional dependence on the legal system to a new legal system. The protection of computer software should rely on the traditional intellectual property law system ;meanwhile,it should reflect the characteristics of software and meet the requirement of the development of the software industry. China should contribute its efforts to this change. The establishment of the special legal protection of computer software can also contribute to the protection of new intellectual property such as integrated circuit layout.
