瑶族法律文化研究——以广西金秀瑶族为例

Research on Legal Culture of Yao Nationality——Taking Jinxiu Yao Nationality in Guangxi as an Example

瑶族法律文化对构建我国多元法律文化,实现社会主义法治目标具有重大意义。从"民族性"和"地方性知识"意义上来解读法律文化的含义是深入分析瑶族法律文化的理论前提。法律文化中所涵盖的法律制度、法律设施以及法律意识是分析瑶族法律文化的基本框架。通过这一基本框架可以比较完整地估计瑶族法律文化的内在含量。当前我国大一统的法律制度很难为瑶族法律文化提供唯一的发展范式。因此,需要考虑瑶族具体情况,积极推进改革、大力发展民族法律教育、谋求国家制定法与瑶族习惯法之间的协调,从而实现瑶族法律文化的现代化。

Legal culture of Yao nationality is of great significance to build multiple legal cultures and realize the target of rule of law in China. The fundamental framework of analysis legal culture of Yao nationality is structure of legal system, legislation and legal consciousness in the legal culture. It is hard for current legal system to provide a unique pattern of development for legal culture of Yao nationality. Therefore, considering the concrete circumstance of Yao nationality, actively promoting reform, development of ethnic law education and coordination of the relationship between customary law of Yao nationality and nation-- established law are needed so as to the realizing the modernization of legal culture of Yao nationality.
