基本犯罪未遂的结果加重犯之犯罪形态议——以强奸罪的结果加重犯为切入点

On Consequential Aggregated Crime Types with Basic Crime not Being Completed——Breakthrough to the Aggregated Consequential Offense of Rape Crime

结果加重犯的既遂和未遂的认定具有理论意义和实践意义,特别是结果加重犯的基本犯罪未遂而加重结果出现的时候如何认定犯罪的形态更具有重要意义。双标准说和单一标准说的认定分歧也导致此问题的认定存在肯定说和否定说的分野。双标准说和单一标准说都很难在实践中起到统一作用,从法益的侵犯、主客观相统一以及结果加重犯的构成、司法实践来看,采取相对的双标准说更具有合理性和科学性。

The standard for the said issue including two types： double standard and sole standard, which result in positive theory and negative theory but both don＇t subside the practical and theoretical conflicts. Protected the legal interest, united the subjective and objected elements, the relative double standard is scientific and rational, viewed from the constitution of aggregated consequential crime and justice practice.
