On Managers’ Responsibility for Their Violation of Safety-Guard Duties

经营者违反安全保障义务的判断标准,包括法定标准、行业标准和合理人标准。在第三人实行的侵权行为中,由经营者承担补充义务的制度不符合安全保障义务制度的初衷,违背侵权法的基本精神,在实施中会与其他制度相抵触。为此,应由经营者与实施侵权行为的第三人按各自过失大小或原因力的比例承担相应的赔偿责任。

On the basis of the experiences of other countries for reference and considering the concrete conditions of our own, the article tries to approach the standards of judgment of the managers＇ safety-guard duties, which include statutory standard, trading standard and ＂reasonable person＂ standard. Then the article doubts the provisions of the complementary responsibility and suggests that the management and the third party, who violates others＇ right, should take relevant responsibility according to the proportion of their respective fault or causal force.
